GENERAL TERMS AND CONDITIONS AND INSTRUCTIONS FOR TOURIST ARRANGEMENTS
I. GENERAL PROVISIONS
The travel agency AVIOBORZA D.O.O. (hereinafter AVIOBORZA) sells its own travel packages, for which it acts as the tour operator, and packages from other tour operators, for which it acts as an intermediary or authorized agency for the sale of their packages.
The general terms and conditions and instructions for tourist packages are an integral part of the travel contract/application form or voucher concluded between AVIOBORZA or an authorized agency and the passenger who submits an order for a specific tourist package.
When selling packages from other tour operators, their General Terms and Conditions apply, unless it is specifically stated that the General Terms and Conditions of AVIOBORZA apply. In cases of special/different terms and conditions or specific features of an individual travel program with regard to any point of the General Terms and Conditions, the information provided in the program shall apply.
The general terms and conditions of other organizers are set out in their general terms and conditions, price lists, or programs, and are usually also listed on their websites. The name of the responsible organizer is listed in the program and catalogs and is stated in the travel contract/application form. The travel organizer is the travel agency that is listed as the travel organizer in the travel contract and guarantees the implementation of the published program in accordance with the content of the arrangement.
In the case of telephone sales or sales via the Internet, the passenger is deemed to have accepted the provisions of these general terms and conditions at the time of ordering the tourist package by telephone or via the Internet. The passenger can familiarize themselves with the provisions of the general terms and conditions and instructions on the website. www.avioborza.si, where they are specially marked and generally accessible.
The customer or passenger is any person who has made a valid reservation or purchased and paid for a tourist package or other AVIOBORZA service and to whom these General Terms and Conditions and Instructions for Tourist Packages apply.
II. REGISTRATION
Passengers can register/purchase a tourist package at an AVIOBORZA branch or at an authorized agency. Upon registration, AVIOBORZA and the passenger conclude a travel contract, which also serves as a booking confirmation and contains information about the passenger's tourist package or refers to the package program where this information is specified.
Upon registration, the passenger is required to provide all information correctly and submit the documents required by the travel program, as well as pay the registration fee or reservation costs.
AVIOBORZA charges the client standard booking fees or a registration fee of EUR 8.00 per registration form for packages worth up to EUR 100.00 per person and EUR 15.00 per registration form for packages worth more than EUR 100.00 per person. When putting together special tourist packages to order, the reservation fee or registration fee is EUR 25.00.
If the passenger does not provide correct information when registering, they are responsible for all costs or consequences arising from the provision of incorrect information.
The passenger's registration is binding. It may be withdrawn in accordance with the provisions on passenger cancellation (point VII of these general terms and conditions). The contract is considered valid upon the customer's signature, as well as upon payment, regardless of whether it has been signed or not.
In addition to an explicit written application or signed contract, any order submitted verbally or in writing that contains the first and last names of the passenger and other participants, the credit card number or identification of another payment instrument, payment of the registration fee or part thereof, payment of registration costs, or any action indicating that the passenger has submitted a binding registration, or a registration containing any of the above information.
III. PAYMENT
The date of payment is considered to be the date on which the passenger makes the payment at the AVIOBORZA agency or at an authorized agency, or when AVIOBORZA receives the payment in its transaction account.
Upon registration, the passenger pays a deposit/security deposit in the amount of 30% of the price of the package or as specified in the travel program, as well as the reservation fee or registration fee. The remaining amount is paid by the passenger at least 8 days before the start of the trip or as specified in the program. However, they may also choose to pay the deposit/security deposit in several installments. Payment terms for closed groups of guests may be agreed upon. In the case of "customized" programs, if there are significant differences between the payment terms of the program subcontractors and the payment terms of AVIOBORZA, the latter shall be adjusted to the terms of the subcontractors (tour operators, carriers, hoteliers, etc.).
When departing on a trip or excursion, the traveler must present the agency representative with proof of payment for the arrangement (payment confirmation, voucher, copy of the transfer order). Otherwise, the tour leader will not accept the traveler on the trip or arrangement.
If the passenger or his/her registration office fails to pay the remaining part of the contractual obligation within the specified period, it shall be deemed that he/she has cancelled the travel contract and the provisions on the passenger's cancellation of the travel contract from point VII of these General Terms and Conditions and Instructions for Tourist Arrangements shall apply mutatis mutandis. Passengers can pay in cash, with credit or debit cards, or transfer the amount to the bank account specified on the invoice. In accordance with the terms and conditions of non-cash transactions of financial institutions, in the case of non-cash payment (credit cards such as Mastercard, American Express, Diners Club, Visa, and debit cards such as BA Maestro) for a tourist package or other service at the AVIOBORZA agency, in the event of a refund, AVIOBORZA cannot pay out cash under any circumstances, but the passenger may request a credit note, and AVIOBORZA may make the refund by transfer to the passenger's bank account, provided that the passenger is entitled to a refund.
Payment for airline tickets with credit cards (remotely) is not possible. Payment by credit card is possible directly at the branch by arrangement.
IV. PRICES
Travel prices are determined by the travel program and are valid from the date of publication of the program.
In addition to the basic price of the tourist package, the traveler is also required to pay all mandatory surcharges (visas, airport, security, and port fees, fuel surcharges, etc.), which, if not already included in the basic price of the package, are added to the basic price of the tourist package and any optional surcharges (single room, room with sea view, higher category of ship cabin, etc.) in the final price and thus represent the final payment obligation of the passenger on the basis of the travel contract.
In accordance with Article 57.d of the ZVPot, AVIOBORZA reserves the right to change the price up to 20 days before the start of the trip in the event of changes in the exchange rate on the basis of which the price of the package was calculated. In accordance with the same article, it reserves the right to change the price if there are changes in carrier tariffs, including changes in fuel costs, increases in airport and port fees, etc.
The price change is calculated using the same percentage as the percentage change in the aforementioned calculation elements.
The traveler has the right to cancel the travel contract if the price increase exceeds 10% of the price of the tourist package. In this case, they are entitled to a refund of the amount paid, without the right to compensation for any visa, insurance, vaccination, and similar costs.
AVIOBORZA may include instructions in the program that the passenger may pay for certain services during the trip at the destination (additional excursions, sports equipment rental, etc.), which will be provided at the destination. In this case, AVIOBORZA does not act as an organizer or intermediary, but solely as an informant. In this case, the passenger shall assert all claims exclusively against the service provider or supplier at the destination.
AVIOBORZA may specify the price of the package in the program, expressly stating that the price may increase if a certain number of passengers do not register or if other precisely defined conditions arise. The passenger registers at a price that is based on the optimal, expected number of passengers, but is also aware of the price for a smaller number of passengers in the program and irrevocably agrees to pay the difference in price between the optimal, expected number of guests and the actual number of guests. AVIOBORZA will notify guests of any price differences in a timely manner.
The prices of additional charges are for informational purposes only, as they are subject to change and AVIOBORZA has no influence over them.
V. SERVICES INCLUDED IN THE PRICE OF THE PACKAGE
Unless otherwise specified in the program, the price of the package includes transportation (airfare – economy class), hotel and catering services, travel arrangements, accident insurance for tourists and excursionists, and VAT.
Unless otherwise specified in the program, the prices of individual tourist packages are per person, for accommodation in standard double rooms (without terraces, special balconies, sea views, etc.).
VI. ADDITIONAL SERVICES
Additional services are those services that are not normally included in the basic price of the package (single room, special diet, room with sea view, optional additional excursions, etc.) or services for which additional payments are required (visa, etc.), so the passenger pays for them separately, unless otherwise specified in the program. If additional services are listed in a particular package, the passenger shall submit their requests for these services upon registration and pay for them in addition to the basic price of the package. The published prices of additional or personal services are valid only in the case of ordering and paying for these services when ordering and paying for the basic package at the registration point.
During the trip, the traveler may pay for special services to the tour leader or representative of AVIOBORZA or representative of the tour operator organizing the traveler's tourist arrangement, in the place where the service is provided, in the appropriate currency, if it is still possible to order this service during the trip, at the price valid at the place itself.
VII. CANCELLATION OR CHANGE OF TRAVEL BY THE PASSENGER
The passenger has the right to cancel the trip at the place of registration for the tourist arrangement or at the AVIOBORZA agency or at an authorized agency. In the event that the passenger cancels the travel contract, AVIOBORZA is entitled to reimbursement of costs due to the cancellation of the travel contract. The amount of the reimbursement depends on the time at which the passenger submitted the cancellation. If the passenger cancels the travel contract, they are obliged to reimburse AVIOBORZA for the costs of the registration fee already paid. The registration fee is EUR 8.00 per application form for packages worth up to EUR 100.00 per person and EUR 15.00 per application form for packages worth more than EUR 100.00 per person. For the creation of special tourist packages on request, the reservation fee or registration fee is EUR 25.00.
If the program specifies different conditions for reimbursement of costs due to cancellation of the travel contract, the conditions specified in the program shall apply. The amount of reimbursement for cancellation of the arrangement depends on the time before the start of the service in which the passenger canceled the travel contract:
– up to 30 days before departure 10% of the trip price
– 29 – 14 days prior to departure 40% of the trip price
– 13 – 06 dni pred odhodom 80 % cene potovanja
– 05 – 00 days prior to departure: 100% of the trip price.
No-show without cancellation – 100% of the package price.
In cases where AVIOBORZA is not the organizer of the tourist arrangement, the terms and conditions of the responsible organizer, which the point of sale attaches to the application document, apply when determining the amount of costs due to cancellation of the trip.
In all cases where the subject of the contract is the purchase of airline tickets, AVIOBORZA is entitled to retain the booking fee (TSC) in addition to cancellation and administrative costs.
In the event of cancellation on the day of departure or even non-participation of the passenger without cancellation, AVIOBORZA will charge the passenger for the full value of the tourist package. If the terms and conditions for reimbursement of costs due to cancellation of the travel contract are specified differently in the program, the terms and conditions specified in the program shall apply.
When canceling a travel contract, the traveler must submit a written cancellation and sign the cancellation document provided by the sales consultant. If the traveler refuses to sign this document, it is considered that the travel contract has not been canceled. During the trip, the passenger may interrupt the trip at their own request and with a written statement of interruption. If the passenger interrupts the trip during the trip, they are not entitled to a refund of costs or purchase price upon return, either in part or in full. If the passenger changes the program during the trip at their own request or does not travel according to the program that is an integral part of the contract with the AVIOBORZA agency, it is considered that the passenger has withdrawn from the contract during the trip. In this case, too, the passenger is not entitled to a refund of costs or purchase price, either in part or in full. In this case, the passenger is liable for the costs and damage caused by the change to the program. In the event of a change to the program at the passenger's own request or due to force majeure, without any reasons on the part of AVIOBORZA due to improperly performed services, the passenger is not entitled to claim any compensation or price reduction. After concluding the contract, the passenger may change the name or number of passengers, accommodation, or travel date, but only on condition that such a change is possible without canceling the arrangement. In the event of such a change (if permitted by the organizer), AVIOBORZA will charge the passenger an administrative fee of EUR 15.00. In certain cases, however, the costs of the change are disproportionately higher. This is particularly the case when the arrangement includes
VIII. CANCELLATION RISK OR CANCELLATION FEE
When a passenger anticipates the possibility that certain circumstances affecting them or their immediate family could force them to cancel their trip, they can pay a cancellation fee/cancellation risk. All details are provided when ordering this service from AVIOBORZA.
If, upon cancellation of the trip, the passenger submits a document or proof that he/she is unable to travel but has not paid the cancellation fee, the agency shall retain the refund for cancellation of the trip as specified in the previous point of the general terms and conditions.
If the passenger does not commence the trip on the date specified as the start of the trip or use of the tourist arrangement and does not submit a written cancellation at least 2 hours before the start of the trip or use of the tourist arrangement without organized transport, they are not entitled to a refund of the payment based on the cancellation fee paid. The start of the trip, which begins with organized bus, air, or ship transport, is considered to be the time of departure of the bus, plane, or ship. In cases where the tourist package does not include organized transport, the start of the trip is considered to be the time when the passenger could actually take over the accommodation facility (usually 2:00 p.m.). It is also considered that the passenger has not started the trip if the passenger is not accepted for transport by the agreed carrier (ship, plane, bus, etc.) for any reason of a regulatory or safety nature, regardless of whether this happened at the beginning of the planned trip or even during the trip. In such a case, the passenger is liable for all damage caused and cannot claim any refunds based on the cancellation fee paid.
The cancellation risk depends on the price of the program and the exact terms and conditions of the insurance company.
Regardless of the cancellation risk paid, in the event of a passenger's cancellation of the trip, AVIOBORZA is entitled to reimbursement of administrative costs amounting to EUR 30.00 per application form and the right to retain the amount of the cancellation risk paid. In the event that the subject of the travel contract is the purchase of an airline ticket, AVIOBORZA shall retain the reservation fee (TSC) in addition to the administrative costs. The passenger is therefore entitled to a refund of the amount paid for the contractually agreed tourist services, reduced by administrative costs, cancellation risk payments, and TSC. AVIOBORZA is not liable for any other costs incurred by the passenger due to the planned trip or other tourist services under the travel contract (e.g., vaccination costs, visas, travel expenses, etc.).
The passenger is also not entitled to reimbursement for cancellation risk if they fail to provide appropriate written proof (medical certificate, sick note, etc.) of a valid reason for canceling the trip. Claims for cancellation risk cannot be made after the start date of the trip, nor for the unused portion of the trip.
In other cases of documented force majeure that do not fall under the events covered by cancellation risk and due to which the passenger cancels the trip or withdraws from the contract, AVIOBORZA is entitled to reimbursement of all costs already incurred, as well as those incurred by the cancellation of the trip itself. Force majeure must be documented with valid official documents and must be such that it could not have been foreseen or avoided before the conclusion of the contract.
Cancellation risk insurance is taken out with an insurance company; AVIOBORZA is merely an intermediary between the passenger and the insurance company. Thus, the passenger's rights under the cancellation risk insurance are exercised with the insurance company, whereby the general terms and conditions of the insurance company apply, while AVIOBORZA mediates and assists the passenger in this process. The insurance company with which the cancellation risk insurance was taken out is responsible for the course and time of the claim settlement.
IX. ORGANIZER'S RIGHT TO CANCEL THE TRIP
AVIOBORZA reserves the right to cancel the trip or change the itinerary in accordance with applicable law. AVIOBORZA reserves the right to cancel the trip no later than 7 (seven) days before the scheduled departure if the number of passengers specified in the program or travel contract is not registered for the trip. Unless otherwise specified in the program or travel contract, the minimum number of passengers in a given means of transport is as follows:
– for travel by bus – at least 40 passengers per bus;
– for travel on regular flights within Europe – at least 25 passengers in each group;
– for travel on intercontinental flights – at least 15 passengers in each group;
– for travel by special aircraft, trains, and ships – at least 80% occupancy of these.
AVIOBORZA reserves the right to withdraw from the contract in whole or in part if, prior to or during the implementation of the program, extraordinary circumstances arise that could not have been anticipated, removed, or avoided, and these circumstances constitute a valid reason for AVIOBORZA not to have concluded the contract if they had existed at the time of its conclusion. In this case, the passenger is only entitled to a refund of the amount paid or to transfer the amount paid to another date.
AVIOBORZA may terminate or withdraw from the contract and claim damages from a passenger who directly violates the provisions of the contract concluded with the AVIOBORZA agency, especially if it is established that the passenger intentionally provided incorrect information about the number of passengers or their age, or if changes occurred during the trip and the passenger did not notify AVIOBORZA thereof.
AVIOBORZA reserves the right to change the date and time of departure or to cancel the trip due to changes in the flight schedule or force majeure, and the right to change the direction of travel if the conditions for travel change (new flight schedule, uncertain situation in the country where the program is organized, natural disasters, or other unforeseen causes beyond AVIOBORZA's control), without special compensation and in accordance with the applicable regulations in passenger transport.
AVIOBORZA cannot be held responsible for changes to the program due to any force majeure during the course of the program. In such cases, it may provide passengers with services in a modified form, depending on the available options. If AVIOBORZA cancels the trip, the passenger is entitled to a full refund of the price paid for the package. In the event of cancellation of the trip by AVIOBORZA, the passenger is not entitled to a refund of the costs of the visa required to enter the country to which the trip was to take place, or the costs of vaccinations required by the program. AVIOBORZA shall immediately notify the passenger of any subsequent changes to the program.
If AVIOBORZA or another travel organizer withdraws from the contract during its performance, it is entitled to fair payment for the agreed services. Likewise, the passenger is not entitled to reimbursement of administrative costs and insurance taken out with an insurance company.
AVIOBORZA is not responsible for delays in flights, ships, or trains, nor for changes to the program that may arise as a result of such delays. In the event that the situation on site does not allow AVIOBORZA to accommodate passengers in the booked accommodation, AVIOBORZA may accommodate passengers in another accommodation of the same category in the same location.
X. TRAVEL DOCUMENTS AND CERTAIN OBLIGATIONS OF PASSENGERS
Passengers intending to travel abroad are required to inform themselves about the applicable regulations regarding travel documents, visas, foreign exchange, customs, and health regulations. Passengers are required to ensure that they, their documents, and their luggage comply with the conditions set forth in the border customs, health, and other regulations of their country, as well as those of the country to which or through which they are traveling.
Passengers applying to travel abroad must have a valid passport or other valid document that allows them to enter the country in question. If individual countries require that the travel document be valid for a certain period of time before its expiry date on the day of entry, the passenger is obliged to comply with these provisions and AVIOBORZA is not liable for any inconvenience or forced interruption of the passenger's journey on this account. Before travelling, or by the deadline specified in the programme, the passenger is obliged to obtain visas for the countries to which they are travelling and to have the vaccinations required for those countries. If the passenger fails to fulfill these obligations, AVIOBORZA shall act in accordance with the provisions on the passenger's cancellation of the trip. If the visa is arranged for the passenger by the AVIOBORZA agency, the latter does not guarantee the successful acquisition of the visa. AVIOBORZA does not reimburse the passenger for the costs of obtaining the visa or for the visa itself. AVIOBORZA does not guarantee the accuracy of information obtained from the relevant embassies. In the event of refusal of entry into a country or other obstacles, all costs shall be borne by the passenger. AVIOBORZA's assistance in obtaining a visa is not usually included in the price of the trip, but is paid for separately. It is considered that the passenger arranges the visa themselves if they do not provide AVIOBORZA with the documents necessary for obtaining the visa within the deadline specified in the program, special information letter, or offer.
Due to international passenger transport requirements (air, sea, bus, etc.), passengers are required to provide all necessary information about all participants in the trip or vacation when registering. The information must fully and accurately match the information in the official documents that the participants in the trip are required to carry with them in accordance with the regulations on crossing the state border and the relevant foreign legislation. In the event that incorrect information causes a delay, additional costs, or interruption of the trip, the traveler alone is responsible for all costs incurred by the trip participants.
If a child under the age of 15 is traveling abroad or from abroad without a parent or legal guardian, in addition to a travel document, they also need permission from their legal guardian (the carrier's rules must be strictly observed). The permission form is of a prescribed form. It can be obtained from the Administrative Unit, which also certifies it, or it can be certified by a Slovenian authority abroad that is authorized to perform consular duties.
The traveler is obliged to respect the house rules in catering and hotel facilities and to cooperate in good faith with the representative of the organizer and the service provider. If the passenger fails to comply with their obligations, they shall be liable to the organiser for any damage caused, and the organiser shall not be liable for any damage that the passenger may suffer in such a case. During the trip, the passenger is obliged to behave in a manner that does not endanger the life or health of their fellow passengers and does not jeopardize the course of the trip itself. If the passenger behaves in a manner contrary to this provision, the organizer's representative has the right to exclude them from further travel without reimbursement of any costs, except for payments made on site.
XI. NOTICES BEFORE DEPARTURE/TRAVEL
For trips with an organized departure, the passenger will receive a final notification no later than 5–7 days before departure. The passenger may receive the departure notification at their email address or by post. If the passenger does not receive the notification within this period, we recommend that they contact the AVIOBORZA agency or the agency where they booked and paid for the trip. The departure notification can also be requested by calling 01/4210 555 or by emailing avioborza@siol.net. Pre-trip notifications for day trips and all arrangements in Slovenia and Croatia with private transportation are not provided, as all instructions are included in the trip itinerary itself.
In the event that the tourist package is organized by another tour operator, the traveler will receive a departure notification no later than two (2) days prior to departure. In the event that the traveler does not receive a notification at their email or postal address one (1) day prior to departure, we also request that they contact their registration
point, the above-mentioned e-mail address and/or telephone number. Any damage incurred because the passenger provided an incomplete or incorrect address for the purpose of completing the referral/voucher or contract shall be borne by the passenger.
XII. HEALTH REGULATIONS
According to World Health Organization regulations, travelers are required to be vaccinated and obtain the appropriate documentation for travel to certain countries. Vaccination is also mandatory if such a regulation is adopted after the conclusion of the travel contract; this is not a valid reason for terminating the contract, provided there are no contraindications for the traveler's health. In this case, the passenger is required to submit a medical certificate. If certain vaccinations are specified or required in the travel program, each passenger must obtain an international certificate – a yellow booklet – with the vaccinations listed. AVIOBORZA is not responsible for any complications or the passenger's interruption of the trip due to the passenger's failure to comply with the health regulations of the country they are entering or the program they have signed up for, nor for any costs associated with this.
XIII. LUGGAGE
The organizer, agent, or intermediary is not responsible for the transport of luggage and is not liable for damaged or lost luggage, nor for the theft of luggage or other valuables in the hotel. Passengers must report lost or damaged luggage to the carrier, hotel, or other direct service provider themselves. For the transport of special luggage, such as bicycles, surfboards, golf equipment, etc., passengers must pay a surcharge to the carrier, usually directly at the airport upon departure. In any case, the transport of such luggage must be announced at the time of check-in, but due to limited capacity, the airline reserves the right to refuse to transport such luggage in any case. All costs or damages incurred as a result shall be borne by the passenger. The transport of baggage up to a certain weight, as determined by the carrier, is free of charge. When traveling by air, passengers are entitled to free transportation of baggage up to a certain weight (as determined by the carrier), with each additional kilogram paid for by the passenger on site in the appropriate currency or according to the airline's regulations. Children under two years of age are not entitled to free baggage transport. In the case of air transport, the airline is solely responsible for baggage, based on the regulations applicable to international air passenger transport. In the event of lost luggage, the passenger shall, upon landing at the airport, fill out the PIR form of the airline that performed the transport at the lost & found department and submit the completed form to the airline representative.
XIV. ACCURACY OF CARRIERS
AVIOBORZA is not responsible for the accuracy of land, sea, and air transport when it is carried out by public means of transport, on regular or extraordinary passenger transport, voyages, or flights. This also applies to the rental of special charter flights, as the timetable is often not known in advance and depends on the availability of aircraft capacity and confirmed flight schedules that are not part of regular flight connections and flights. The liability of carriers is appropriately specified in the contract between the passenger and the carrier, which comes into force upon use of the means of transport. AVIOBORZA is not liable for any damage resulting from delays, cancellations, or changes to transport or means of transport. AVIOBORZA reserves the right to change the timetable, aircraft types, carrier, and flight direction (stopovers, flights via another airport, etc.) due to various technical and organizational reasons. Delays may also occur, most often as a result of airspace congestion, strikes, and bad weather, over which the organizer has no control.
The changes referred to in the previous paragraph do not count as a change to the travel program in the case of package travel arrangements, as the first and last days of the trip are intended exclusively for arrival and departure at the destination and related transport, and not for rest and sightseeing.
The passenger is obliged to check the return time with the organiser's representative 48 hours before the return.
XV. LOSS OF DOCUMENTS
If a passenger loses their documents during the trip or if they are stolen, but are necessary for continuing the trip or returning home, the passenger shall obtain new ones at their own expense. When arranging the formalities in this regard, the passenger may contact the tour leader or a representative of the AVIOBORZA agency or a representative of the tour operator organizing the passenger's travel arrangement for advice and assistance. If the traveler has to interrupt their trip due to the loss or theft of documents, they are not entitled to any refund of the trip or reimbursement of costs.
XVI. INFORMATION
The information provided to the passenger at the check-in desk is not binding on AVIOBORZE any more than the information provided in the program or offer. In case of doubt, the following shall always be considered valid: written offer, written information, or written explanation. Prices and photographs published at authorized agencies for the sale of AVIOBORZA programs or on the websites of accommodation facilities and in their catalogs are for informational purposes only, insofar as they conflict with other information in the written program, written information or written explanation provided by the AVIOBORZA agency prior to the conclusion of the tourist arrangement contract, the AVIOBORZA agency does not guarantee the accuracy of this information.
The information provided in the weather tables is a statistical average over several years and serves only as a guide for travelers. Therefore, AVIOBORZA is not liable in the event of any discrepancy between this information and the actual situation.
XVII. CATEGORIZATION OF ACCOMMODATION FACILITIES AND GENERAL HOUSE RULES
Accommodation in the programmes is marked in accordance with the official national categorisation in individual countries, valid at the time of publication of the programme, over which the organiser has no influence. The standards of tourist offers among the selected destinations vary and are not comparable. It should be noted that the categorization criteria in some tourist destinations differ significantly from those applicable in the Republic of Slovenia or in most Western European countries, so it is recommended to book higher category accommodation in these destinations.
The organizer shall not be held liable for any written or verbal information provided by the organizer's authorized agency that is not in accordance with the descriptions of services in its program.
House rules, food, services, the beach, and other hotel offerings are overseen by local tourism organizations. The organizer has no influence over these elements either.
For packages marked "all inclusive," it is important to carefully read the description of services in the program or offer, as not all "all inclusive" offers are the same. Usually, the basic service in an "all inclusive" offer is full board (breakfast, lunch, and dinner), with drinks included with meals.
If the traveler does not pay extra for a room with special characteristics (sea view, balcony, location, specific floor) when making the reservation, they will be accommodated in one of the rooms that are officially registered for guests at the hotel. The allocation of rooms is the responsibility of the hotel management; the tour operator has no influence in this matter and can only pass on the passenger's wishes, but cannot guarantee that they will be fulfilled. When staying in a single room, the traveler should bear in mind that it usually does not meet the standard of a double room, as single rooms are generally smaller and have a less favorable location. When staying in a triple room, the passenger must take into account that this is usually a double room with an extra bed, and that the accommodation for the third person does not meet the standard of accommodation for the other two persons. In most cases, this third bed is a folding bed, which is not the same size or as comfortable as a normal bed and is suitable for children.
XVIII. COMPLAINTS OR APPEALS
The traveler must report any irregularities or shortcomings on the spot to the guide or tour leader, the representative of the tour operator organizing the traveler's tourist arrangement, the direct service provider, or the authorized local agency. If, based on the content, the complaint could be resolved on the spot (e.g., poor cleanliness of the room, equipment, location of the room, etc.), but the passenger did not report the fault on the spot and did not inform the above-mentioned persons of the irregularity, it is considered that the passenger agreed with the service provided and thus lost the right to make subsequent complaints with a request for a reduction in the price of the service or payment of damages. If the complaint could not be resolved on the spot, it is necessary to draw up a complaint report, which must be signed by a representative of the AVIOBORZA agency or a representative of the responsible tour operator or service provider and the aggrieved passenger. AVIOBORZA will not consider complaints that are not accompanied by a report from the representative of the organizer or service provider, which shows that the deficiency could not be resolved on the spot.
Complaint procedure: The passenger shall immediately complain about the inadequate service to the representative of the organizer on the spot, or in his absence, to the service provider. The passenger must cooperate with the representative in good faith to resolve the cause of the complaint. If the passenger does not accept the proposed solution to the complaint, which corresponds to the services paid for according to the program, AVIOBORZA will not consider subsequent claims for compensation or a reduction in the price of the trip. If the cause of the complaint cannot be resolved, the passenger shall draw up a complaint report with the representative. After returning from the trip, the passenger must send a written complaint by registered mail within the statutory period, i.e. within eight (8) days of the end of the trip, to the following address: AVIOBORZA d.o.o., Rimska cesta 14, 1000 Ljubljana or by e-mail to: avioborza@siol.net, and attach evidence to substantiate the complaint (mandatory written confirmation signed by the representative or service provider, any invoices for additional costs, etc.). The complaint must be signed and may be submitted by each passenger on their own behalf or by authorizing a third party in writing. The authorization must be attached to the complaint. The complaint must be valid and justified. The passenger should attach the relevant confirmation from the hotelier, carrier, or other service provider regarding the actual situation on the basis of which the passenger is making their claim.
The amount of compensation is limited by law to the amount paid for the package. If, through the fault of AVIOBORZA, the planned program or certain services are not provided, the passenger is entitled to compensation equal to the actual value of the services not provided. This provision does not apply if AVIOBORZA has the right to cancel the arrangement or change the program in accordance with the provisions of these General Terms and Conditions. The passenger is not entitled to compensation for lost profits or reimbursement for non-material damage and costs arising therefrom.
The organizer is obliged to respond to the passenger in writing within 8 days of receiving the complaint, and to provide a final response within a reasonable time necessary to obtain information about the cause of the complaint from the service provider; or, within the time necessary to obtain information from third parties in accordance with Article 892 of the Obligations Code. Until the organizer issues a response to the passenger's complaint, the passenger shall refrain from forwarding the complaint to third parties and competent institutions or providing information to the media and other public bodies. The organizer will only resolve complaints where the cause could not be remedied on the spot. In the event of a complaint about a trip for which AVIOBORZA is not the trip organizer, AVIOBORZA will forward the complaint to the responsible trip organizer and notify the passenger in writing of the resolution of the complaint.
We inform passengers that foreign organizers have a shorter time frame for submitting complaints, so we advise passengers to send their complaints as soon as possible (their General Terms and Conditions must be taken into account).
In the event that AVIOBORZA acts solely as an informant, the passenger must submit all complaints on site to the actual organizer of the optional excursion, tour, sporting activity, etc.
Without a written complaint, AVIOBORZA will not consider requests for price reductions, compensation, or other claims.
XIX. PROTECTION OF PERSONAL DATA
AVIOBORZA protects all personal data obtained about passengers in accordance with the Personal Data Protection Act. By signing the contract in accordance with Article 10(2) of ZVOP-1, the passenger is deemed to have given their consent to the processing of personal data for the purpose of concluding and performing the contract.
By accepting these General Terms and Conditions, the passenger also gives their consent to AVIOBORZA to use their personal data for the following purposes: direct marketing, market research, business analysis, customer segmentation, statistical processing, and notification of offers from AVIOBORZA and its business partners. If the passenger does not wish to give such consent, they may indicate this when registering for the trip.
XX. SPECIAL PROVISIONS OF THE CONSUMER PROTECTION ACT
The area of contracts, obligations, and rights of passengers and responsible organizers is covered by the Consumer Protection Act in Chapter 6: Contracts for Tourist Arrangements in Articles 57 and 58. In order to gain a thorough understanding of their rights and obligations, travellers can check the information in the aforementioned Act, which is also available on the website.
XXI. FINAL PROVISIONS
The prices quoted by AVIOBORZA already include value added tax.
In the event of a dispute between the parties, the court in Ljubljana shall have jurisdiction over the dispute.
These general terms and conditions shall apply from the date of conclusion of the contract.
SPECIAL TERMS AND CONDITIONS FOR TOURIST ARRANGEMENTS
A) WHERE THE AGENCY AVIOBORZA IS NOT THE ORGANIZER OF THE TRIP
If AVIOBORZA is not the tour operator, it acts as an intermediary. In such cases, it provides the traveler with information received from the responsible tour operator and assists them in registering for the trip. The conditions for registration, payment of the registration fee, the deadline for final payment, and the conditions for cancellation of the trip are in accordance with the General Terms and Conditions of the other party – the responsible tour operator.
These programs are specifically identified, and the name of the responsible organizer is stated on the application form/travel contract. AVIOBORZA is considered to be selling such arrangements on behalf of and for the account of a third party. Any complaints are therefore handled by the tour operator.
B) IN THE CASE OF ACCOMMODATION IN HOTELS AND APARTMENTS
If the desired, ordered, and paid tourist package is based on hotel accommodation, it is usually possible to enter the rooms after 2 p.m. on the day of the start of the individual package. On the last day of the package, guests must check out by 10:00 a.m. or 12:00 noon at the latest. In the case of apartment buildings or individual apartments, check-in is usually possible after 4:00 p.m. on the day of the start of the package. On the last day of each package, guests must leave the apartment by 10:00 a.m.
C) IN THE CASE OF INDIVIDUAL REGISTRATION FOR ACCOMMODATION IN DOUBLE ROOMS
In the case of individual registration for tourist packages or trips, the passenger may request that AVIOBORZA try to find a travel companion on the same tourist package who is willing to share a room with them. Regardless of the above, an individual registered traveler must pay a single room supplement upon registration if AVIOBORZA is unable to find such a traveler for the individual registered traveler. If a travel companion is found for an individually registered passenger in accordance with the first paragraph of this point, the surcharge for accommodation in a single room will be refunded to that passenger, or the surcharge will be deducted from the final payment for the trip.
D) FOR INTERCONTINENTAL TOURIST ARRANGEMENTS
Passenger registrations for intercontinental travel and intercontinental tourist packages are accepted by AVIOBORZA and other authorized travel agencies until all available seats are filled, but no later than 60 days prior to departure. If the tender options for a particular trip or tourist package allow it, registration is also possible at a later date. Upon registration, the passenger pays a registration fee of 30% of the value of the package, the remainder is paid in installments, and the last installment must be paid no later than 14 days before the start of the trip. If the traveller registers for a trip or tourist package within 60 days of the start of the trip, AVIOBORZA does not guarantee the advertised terms and conditions of the trip or package, but rather the most favourable terms and conditions available at the time.
AVIOBORZA is not responsible for changes in flight arrival or departure times, which may be changed by the airline.
E) TELEPHONE SALES OF TOURIST PACKAGES
In the case of telephone sales of tourist packages, the contract is considered concluded:
– by written confirmation via email,
– by transferring the agreed advance payment to the TRR,
– by payment (credit card, cash) at the branch office, by providing the personal data of the passenger and other participants.
In this case, the passenger is obliged to pay for the ordered service based on the reservation number within 3 days of the completed registration, unless a longer or shorter deadline has been specified or agreed upon. If the passenger does not pay within this period, the contract shall be deemed not to have been concluded. The passenger shall be deemed to have accepted the provisions of these General Terms and Conditions and the offer at the moment when they order the tourist arrangement or trip by telephone.
F) TRAVELING WITH CHILDREN
F) TRAVEL In individual cases specified by the individual tourist package program, it may be stipulated that minor children up to the age specified by the same program, who are traveling accompanied by two adults and staying with the adults in the same room, discounts on individual services from the entire tourist package or on the entire tourist package. The conditions and amount of each discount are specified in each individual tourist package program. If a particular program does not provide for special discounts for minors traveling with adults, this means that this tourist package does not provide for such special discounts. WITH CHILDREN
Every child, regardless of age and any discounts, must be listed on the travel document and must have valid documents required for entry into foreign countries to which they are traveling. If a child is not listed on the travel document or voucher for a particular tourist arrangement, that child is not considered to have the right to travel under that tourist arrangement.
G) LAST MINUTE TRAVEL OR LAST MINUTE ARRANGEMENTS AND OTHER LOWER-PRICED ARRANGEMENTS
A last-minute trip or "last minute" package means that these are the last available tourist packages. The organizer occasionally has the option of offering certain specially marked lower-priced packages, for which the name of the hotel is not necessarily known at the time of conclusion of the contract. This means that the name of the facility is not yet specified in the travel contract. For these packages, the organizer guarantees the information specified in the contract, which includes at least: the category of the facility (according to the official national classification), the type of room, hotel services (overnight stay, half board, all-inclusive, etc.), and the location of the accommodation. For these arrangements, the traveler is informed of the name of the accommodation facility no later than in the departure notice.
H) AIR TRANSPORT
Low-cost airlines
The basic price of an airline ticket includes air transport and hand luggage (the weight/size of hand luggage depends on the carrier). Low-cost airlines do not include the following in the price of the ticket: food and drinks, checked baggage, seat reservations, and check-in. Detailed information can be found on the website of the desired airline or low-cost carrier.
Check-in for flights is charged at the airport, but we definitely recommend checking in online on the airline's website.
Flights are mostly operated to smaller or less important airports, so passengers should check their departure and arrival locations. These airports are usually located far from city centers, so we recommend that passengers check the prices of transportation to and from the airport.
Each passenger is responsible for checking the current regulations of the low-cost carrier with which they are traveling. When registering, you must provide your first and last name as they appear on the travel document you will be traveling with (valid ID card or passport). Some carriers also require the number, validity, and type of the personal document you will be traveling with, as well as your date of birth.
Any subsequent change to the information required for travel will result in additional costs in accordance with the rules of the individual low-cost airline.
AIR CARRIERS
The general terms and conditions of airline tickets are determined by the carrier.
I) TRAVEL INSURANCE – PACKAGE SALES
Accident insurance for passengers is the responsibility of each individual, unless otherwise specified.
In the event of personal injury, damage to property, or theft, immediately notify the tour operator or the police. In the case of air transport, the airline is responsible for baggage in accordance with the regulations applicable to international passenger transport.
We recommend that all customers take out additional health insurance for travel abroad (CORIS), which can help ensure a stress-free and, above all, affordable trip in the event of illness, hospitalization, emergency medical assistance, emergency transport, or a special flight needed for a sick passenger, it can help ensure stress-free and, above all, affordable treatment for the passenger and their return home.
